KING CITY — After more than two years of legal challenges, the development of a new Grocery Outlet in King City is set to move forward.
Best Development’s proposal for a store located at 1023 Broadway St. gained momentum after a recent ruling from the Sixth District Court of Appeals. The project, which has been in the works since early 2021, includes a single-story building spanning about 18,187 square feet, with 72 parking spaces and 13,908 square feet of landscaping.
Initially approved by the City’s Planning Commission, the project faced an appeal from UFCW Local 5, a union representing employees from other local businesses, citing non-compliance with environmental regulations.
In April 2022, the City Council upheld the Planning Commission’s approval, but the case subsequently moved to trial court. The court ruled in favor of the City and the grocery store, prompting UFCW Local 5 to appeal to the Sixth District Court.
On Oct. 21, the appeals court issued a decision ruling in favor of the City, stating that the union’s claims regarding environmental regulations had “no merit” and awarded costs to both Best Development and the City. The ruling clears the path for Grocery Outlet’s construction.
“This represents a substantial victory for our city,” said Mayor Mike LeBarre. “It helps everyone in our community who struggles to put food on the table and highlights the significant economic development efforts underway to bring new commercial businesses and shopping opportunities to King City.”
King City was represented in the litigation by Aleshire & Wynder, LLP, while Best Development was represented by Remy, Moose, Manley, LLP.
